Virtual Practice Clarification

 

As an Associate Marriage and Family Therapist (AMFT #154230) and Associate Professional Clinical Counselor (APCC #19060) licensed in California, under the supervision of Nicole Botaitis (LMFT #47319, LPCC #227), I provide virtual therapy services from Texas. California law (Business and Professions Code §§ 2290.5, 4980.43.4, and 4999.46.4) permits me to offer telehealth services to California residents, governed by my California licensure and supervision.

My virtual practice ensures access to clients throughout California while upholding the ethical standards, confidentiality protocols, and clinical best practices required by the California Board of Behavioral Sciences. All sessions, records, and communications comply with California telehealth regulations (16 CCR § 1815.5), delivering the same quality of care as in-person services.

TELEHEALTH PLATFORM & SECURITY

All therapy sessions are conducted via a HIPAA-compliant telehealth platform to ensure confidentiality and security. Before our first session, you will receive instructions on accessing the platform and preparing for your telehealth session.​

TECHNOLOGY REQUIREMENTS

To participate in telehealth sessions, you will need:

  • A reliable internet connection.

  • A device with a camera and microphone (computer, tablet, or smartphone).

  • A private, quiet, and confidential space where you feel safe and won’t be interrupted.

  • A backup communication method (phone) in case of technical difficulties.

EMERGENCY PROTOCOLS

Telehealth has limitations during emergencies. Before starting therapy, we will establish an emergency plan, including:

  • Local emergency contact information.

  • Crisis resources specific to your location in California.

  • A designated emergency contact person.

  • Clear procedures for managing a crisis during a session.

PRIVACY CONSIDERATIONS

To maintain confidentiality and safety during telehealth sessions:

  • Conduct sessions in a private, secure location.

  • Use headphones when possible to protect your privacy.

  • Do not record sessions without explicit mutual consent.

  • Ensure others cannot hear or see your screen during sessions.

  • Confirm your environment is safe and free from interruptions or distractions.

UNDERSTANDING YOUR INVESTMENT

PAYMENT & INSURANCE INFORMATION

My practice operates on a private-pay basis and does not directly accept insurance, allowing for personalized care tailored to your needs.

What This Means For You
  • Payment is due at the time of service.

  • I can provide a superbill (a detailed receipt with service codes) for potential out-of-network insurance reimbursement.

 

Important Considerations About Insurance Reimbursement

If you seek insurance reimbursement, note:

  • Insurance companies typically require a mental health diagnosis to process claims.

  • Submitting claims may involve sharing therapy notes or records, potentially impacting privacy.

  • Mental health records may become part of your permanent medical record, possibly affecting future employment or insurance premiums.

  • Private pay means no diagnosis is submitted to external organizations.

  • Reimbursement amounts vary by insurance plan.

  • You are responsible for submitting all paperwork to your insurance provider.

Private-pay therapy offers greater privacy, no diagnosis requirement, and the flexibility to choose a therapist that best suits your needs.​

Your Right to a Clear Cost Estimate

Under the No Surprises Act (Section 2799B-6 of the Public Health Service Act), healthcare providers must provide a Good Faith Estimate of expected costs for uninsured or out-of-pocket clients. For details, visit www.cms.gov/nosurprises or call 1-800-985-3059.

What This Means for You

You’ll receive a clear estimate of service fees:

  • Upon request.

  • When scheduling.

  • Both verbally and in writing.

Your Rights:
  • A written estimate of expected costs at least 1 business day before your session.

  • The ability to challenge any bill exceeding the estimate by $400 or more.

I aim to keep costs straightforward so you can focus on your progress. Questions are always welcome.​

Practice Guidelines

All therapeutic services adhere to:

  • California Board of Behavioral Sciences ethical standards and regulations.

  • HIPAA privacy and security requirements.

  • Evidence-based therapeutic practices.

  • Regular clinical supervision and consultation.

I am legally required to report:

  • Suspected child abuse or neglect.

  • Suspected abuse of elderly or dependent adults.

  • Serious threats of harm to oneself or others.
